We should all know that litter, graffiti, fly-tipping, fly-posting, excess trade waste and additional household side waste makes our district look dirty and un-kept. Are you aware these activities constitute an environmental crime and these crimes and anti social behaviour will not be tolerated by the council?
The council have the powers to prosecute residents and businesses who commit environmental crimes. This can include warnings, fines and prosecutions. Daventry District Council's Public Space team are tackling these problems to improve our district and ensure it is kept clean and tidy. We will ensure environmental crimes will be rectified and the offenders of those crimes will be penalised.

We are responsible for all public highway and public space to ensure the environment is a clean, green and safe place to live. Education and enforcement can be undertaken to achieve this. We are not responsible for private property, land owned by parish councils, road signs, and some elements of street furniture including bus shelters and telephone boxes.
The Law
The Environment Protection Act 1990 and the Clean Neighbourhood and Environment Act 2005 gives local authorities the power to enforce against environmental crimes. Other legislation is available for enforcement purposes to prosecute offenders of environmental crime.
Fixed Penalty Notices
A fixed penalty notice is a fine. If an enforcement officer believes you have committed an offence he or she may decide to prosecute you for the offence. However they may decide to issue a fixed penalty notice instead. By paying the notice the council cannot prosecute you for the offence.
Fixed penalty notices will be issued to individuals and businesses who commit any environmental crime.
We will issue a fixed penalty notice for £75 to those who litter, graffiti, flypost, or place additional waste out for collections. Failure to pay these fines can result in greater fines of up to £2500 by the Magistrates Court. Fixed penalty notices will be issued for small amounts of flytipping but fines will be greater for this.
Why you have been issued with a fixed penalty notice?
You have been issued with a notice as you, or your business, has committed an offence under current legislation by defacing public property, leaving waste in a public place, or not following council guidelines.
How to appeal
If you feel you have been issued with a notice unfairly you are able to appeal to the council. You will need to write a letter to us within a week of the fine being issued. Please quote the fixed penalty serial number and details of why you believe this to be issued unfairly to: -

A decision will be made and notified to you within 2 weeks. An unsuccessful appeal will result in the requirement to pay the notice immediately.
Payment of fixed penalty notices
All fixed penalty notices must be paid within 14 days of it being issued.
Failure to pay a fixed penalty notice
Failure to pay the notice will result in a prosecution case being taken against you for the offence committed, not the failure to pay the fine. A prosecution case may result in you receiving a greater fine in the Magistrates Court or Crown Court depending upon the seriousness of the offence.
