Local Land Charges

 A Local Land Charge search is a very important step towards buying a new home. Land Charge Registration was established by Act of Parliament in 1925 to inform those buying land & property of any obligations enforceable by Local Authorities and other public bodies.

 

Main Types of Land Charges

 

Planning Permissions


A consent given by the Local Planning Authority to carry out development.

 

Tree Preservation Orders


This Order makes it an offence to cut down, top, lop, uproot, wilfully damage or destroy a tree without the Planning Authority's consent.

 

Conservation Areas


Areas of special architectural or historic interest. Special planning controls apply.

 

Enforcement Notice


These relate to changes of use of land, or works which have been carried out without planning permission, or to non compliance with a planning permission.

 

Housing Grants


Grants for works to repair or improve residential property impose conditions on rents and resale within 5 years.

 

Special Site of Scientific Interest (SSSI)


Areas of special interest that are protected against damage under Section 28 of the Wildlife & Countryside Act 1981.

  • Completed copies of the LLC1 search form & Con 29 form.
  • A detailed plan of the property in duplicate.
  • Additional enquiries in duplicate.
  • The correct fee - please make cheques payable to 'Daventry District Council'.
  • Please ensure you submit the search at least 15 working days before it is required.

Water Company Searches


In addition to a Local Land Charge search, a separate search must also be made to the relevant Water Company.

Daventry District is served by three Water Companies, Anglian, Severn Trent and Thames. The parishes covered by each company are:

  • Severn Trent Water
    Barby, Braunston, Catesby, Clay Coton, Crick, Elkington, Hellidon, Kilsby, Lilbourne, Naseby, Staverton, Sulby, Welford, Winwick, Yelvertoft.
  • Thames Water
    Byfield, Canons Ashby, Charwelton, Woodford Halse.
  • Anglian Water
    Anglian Water cover all other parishes in the district that not listed above.

 

Personal Searches


Personal Searches give information on registrations and planning permissions and cost £11.

A personal search can be arranged at any time during normal working hours, Monday -Thursday 9.00am - 5.00om and Friday 9.00am - 4.30pm. Simply call the Local Land Charges Officer and arrange a convenient time.
